Price shown is for first month of the agreement (less enrollment fees). Subsequent months will be billed automatically via Credit Card or ACH that is on file with Fit Club 24. You will be reimbursed for the prorated amount of the current month.

Please add an enrollment fee to the cart for each new member (including Add-On Family Members).

Entry Key Fobs will be issued upon checkout & available for pickup at the Fit Club 24 location.

By purchasing through the Fit Club 24 online store you agree to all parts of the Fit Club 24 Membership Agreement & Waiver of Liability. You also agree to complete your agreement based on the terms that are selected above. If you fail to add an enrollment fee for each new member of the agreement, you will be responsible for the enrollment fee at a later date.

MEMBERSHIP AGREEMENT & WAIVER OF LIABILITY

By signing I Agree to enter Fit Club 24 at my own risk and not give my access information to anyone or bring anyone in before or after guest visitation hours. I also agree to all sections of the membership agreement & waiver of liability.

Terms of Membership and Renewals: You have the option to cancel this membership any time after the initial term as set forth by this contract by filling out a cancellation form at Fit Club 24. Cancellation shall be effective thirty (30) days after the receipt of notice. Should intent of cancellation not be provided after initial term of membership, the term of this contract shall be extended for consecutive periods of one (1) month each.

Late Fees: Your membership dues are due at the first of each month. If for whatever reason we are unable to collect those dues, your payment will be considered late on the 7^th of that month & a $25 late fee will be assigned to your account. A $5 late fee will be assigned for each additional day following the 5^th of the month. If for whatever reason you need a few extra days for the grace period, please let us know in advance; we are happy to work with you.

If you decide you do not wish to remain a member of Fit Club 24, you may cancel this agreement by mailing to Fit Club 24 by midnight of the third business day after the day you sign this contract a notice stating your desire to cancel this contract. The written notice must be mailed by certified mail to the following address: Fit Club 24, 24525 Gosling Road, Suite D, Spring, TX 77389.

Consumer’s Right to Cancellation: This agreement may be canceled by giving written notice in the form of a Cancellation Form available at the Fit Club 24 office or written notice delivered via Certified Mail to the Fit Club 24 office. Please allow up to thirty (30) days for processing of cancellation. Except as otherwise provided, this contract may be cancelled only under the following terms and conditions:

A: If Fit Club 24 goes out of business and fails to provide facilities within ten (10) miles of the facility in which you are enrolled or Fit Club 24 moves more than ten (10) miles from its present address you may cancel this contract by mailing by certified mail a written notice stating your desire to cancel this contract, accompanied by proof of payment on the contract to the following address: Fit Club 24, 24525 Gosling Road, Suite D, Spring, TX 77389.

B: If you die or become totally and permanently disabled after the date this contract takes effect, you or your estate may cancel this contract and receive a partial refund of your unused membership fee by mailing a notice to Fit Club 24 stating your desire to cancel this contract. Fit Club 24 may require proof of disability or death. The written notice must be mailed by certified mail to the following address: Fit Club 24, 24525 Gosling Road, Suite D, Spring, TX 77389.

C: Relocation: A member in good standing may cancel their membership after the date of this contract upon permanent relocation of their residence, subject to the following conditions. If you permanently relocate your residence and there exists no Seller affiliated facility within a 10 mile radius. Cancellation is subject to acceptable proof, such as copy of a lease, public utility connection, etc. as may be required by Seller and is binding on the Seller only when in writing and signed by an authorized representative of the Seller. You will be responsible for the payment of all dues that accrue under the terms of the contract prior to the fulfillment of the above conditions.

D: Outside of the reasons listed above, a member in good standing may only cancel their membership by filing a Cancellation Form, paying a penalty of $250 or the remainder of their agreement (whichever is smaller) & returning their issued key fob.

Liability Waiver: It is agreed that all use of the facilities shall be undertaken by you at your own risk. Fit Club 24 shall not be liable for any injuries to a member or guest, or their property, whether lost, damaged or stolen. Member further agrees to indemnify and hold harmless Fit Club 24 or any of its agents, successors, officers or assigns. Any damages to the facility or to the property of another member or guest shall be the responsibility of the offending member. If you have a history of heart disease or other medical/physical illness, you should consult a physician before utilizing any of the facility.

Restrictions or Cancellations or Assignments: You understand that failure to use membership, facilities, or programs dues not relieve you or your ability for payment, regardless of the circumstances and your membership is nonrefundable, nontransferable, non-assignable except as provided in the contract. In the event of default in the payment of any sums specified herein, you understand that Fit Club 24 may at its option, demand immediate payment of all unpaid installments, institute collection proceedings and/or litigation to collect such amounts; in which event you agree to pay all resulting collection costs and reasonable attorney’s fees. Member agrees that any resulting judgment is with waiver of personal property exemptions allowed under State Law. Fit Club 24 reserves the right to cancel any membership upon violations of any of the club’s rules or regulations at the member’s expense.

Hours of Operation: 24 Hours/Day, 7 Days/Week, 365 Days/Year

Member Check In: All members upon entering the club are required to check in and/or sign in at the main counter upon each visit. Members may be issued membership cards and required to present at each visit to facility.

Child Sitting: We do not offer a specific child care area, however your children are welcome to occupy the lounge area (with no supervision provided) assuming they are not being a nuisance to other guests. You are responsible for your children’s safety.

No person under the age of 18 is permitted to become a member of Fit Club 24 without Parental Consent

Notice: While on premises of the club, you are granting your permission to be filmed, videotaped or photographed by any means and are granting full use of your likeness, voice and words without compensation.

Notice: Your club key is given to you as a membership privilege. The key is the property of Fit Club 24. If the key is lost, stolen or damaged, there will be a $20.00 replacement fee. If the key is not returned the Fit Club 24 at the end of your membership, you will be billed $20.00.

Equipment Malfunctions: Member understands the equipment may, from time to time, be out of order. When proprietary factory parts must be ordered, some units may be out of order for several weeks. When this occurs, the member agrees to follow a regulated substitute program.

Guest Privileges: A member, subject to management approval, may invite as many guests as member desires; the same guest may not visit more than three (3) times and must be at least 18 years of age. Club reserves the right to charge guest fees.

Amendments of Rules: The club reserves the right to change and/or add to these rules as it may be necessary for sale and proper management of the facilities and its programs.

Warranties: Member agrees that no warranties, representations, agreements, fitness for a purpose otherwise, expressed or implied, were made to member except for those written herein or in writing, signed by an officer of the corporation owning the club.

Incidental Programs and Services: Member acknowledges the purchase of a membership in a physical fitness facility. Club may provide programs, exercise classes, services or equipment related to physical fitness and may not be required to continue any particular program or service as part of its contractual obligations herein and may change, or modify at its discretion, without recourse by member.

Smoking, alcoholic beverages, non-prescription drugs, including anabolic steroids and/or tobacco, in any form, are forbidden on the premises.

Tanning: Member acknowledges that they may only tan once per calendar day for a maximum of 20 minutes per day and may not let anyone else use their tanning membership. If member is found to be using the membership fraudulently; whether by tanning more than allowed in a given calendar day or allowing someone else to use their membership, the membership will be terminated at member’s expense and member will pay remaining balance plus fees.

Entire Agreements: This is the entire agreement and can only be modified in writing.
